Is Marijuana Coming to Wisconsin?

Right now, marijuana is still illegal in Wisconsin for both medical and recreational use; Wisconsinites cannot legally buy, use, or grow marijuana. Wisconsin does not have a medical marijuana program, and possessing marijuana can lead to criminal charges.

What Bills Are Being Introduced?
In early 2026, Wisconsin Democratic lawmakers introduced a new bill, LRB-4219, that would legalize marijuana for both recreational and medical use. If passed, the bill would allow individuals with certain medical conditions to use marijuana for treatment, and adults 21 and older would be able to possess and use marijuana, while the state would create rules for growing, selling, and regulating it. The bill specifies that the following medical conditions or treatments qualify a person for the registry:
Cancer
Glaucoma
AIDS or HIV
Crohn’s disease
A hepatitis C virus infection
Alzheimer’s disease
Amyotrophic lateral sclerosis (ALS)
Nail-patella syndrome
Ehlers-Danlos syndrome
Post-traumatic stress disorder (PTSD)
The treatment of any of these conditions: opioid abatement or reduction or treatment for opioid addiction; a chronic or debilitating disease or medical condition, or the treatment of such a disease or condition that causes cachexia, severe pain, severe nausea, seizures, or severe and persistent muscle spasms;
Any other medical condition or treatment DHS designates by rule as a debilitating medical condition or treatment.
Supporters say this proposal would improve personal freedom, modernize public health policy, and make Wisconsin more like neighboring states that have already legalized marijuana.
The bill faces significant challenges, however, since Republicans currently control both the Wisconsin Assembly and the State Senate. Many GOP lawmakers have historically opposed broad marijuana legalization.
A Separate Medical Marijuana Effort
Another bill, Senate Bill 534, focuses only on medical marijuana. This proposal would create a regulated program allowing patients with qualifying medical conditions to use marijuana legally with a doctor’s approval. It would establish licensed growers, processors, and dispensaries, and registered patients could purchase medical marijuana without fear of legal trouble.
This approach is seen as more politically feasible because it focuses on those who need marijuana for health reasons rather than allowing recreational use for all adults.
What Could Change Next?
Currently, Wisconsin is watching two main paths:
LRB-4219, which would allow adults 21 and older to use marijuana freely and set up a full legal market.
Senate Bill 534, which would allow patients with qualifying conditions to use marijuana legally with a doctor’s support.
Both bills still need to pass the legislature and be signed by the governor before becoming law. Republicans control the legislature, so the future of marijuana legalization in Wisconsin is uncertain and could take time.
